General Terms and Conditions

Effective from 15 October 2026, version 1.5

This is an English translation provided for your convenience. The legally binding version is the Czech original; if the two differ, the Czech version prevails.

1. Introductory provisions and definitions

These general terms and conditions (the “Terms”) govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (the “Civil Code”), the mutual rights and obligations of the operator and the customer arising in connection with booking and using the private self-service gym Room4Fitness.

The “Operator” is the person specified in Article 2. The “Customer” is a natural or legal person who concludes a contract with the Operator through the booking system at room4fitness.cz. A “Consumer” is a Customer who is a natural person acting outside the scope of their business or independent profession.

A “Space” is a specific Room4Fitness self-service facility (the gym or the multi-purpose hall for yoga and group exercise) that the Customer books for exclusive use for the agreed period. A “Booking” is a binding order of time blocks in a specific Space.

By submitting a Booking, the Customer confirms that they have read these Terms, agree with them and have full legal capacity. The Operator may amend the Terms; each Booking is governed by the Terms in effect on the day it was submitted.

A “User account” is an optional account held by the Customer in the booking system. Creating one is not a condition of making a Booking or of concluding the contract.

2. Operator

The Room4Fitness service is operated by Urban Network s.r.o., company ID (IČO) 24963437, with its registered office at Jana Palacha 17, 252 63 Roztoky, Czech Republic, registered in the Commercial Register kept by the Municipal Court in Prague, file no. C 446075.

3. Subject and purpose of the rental

The subject of the contract is the short-term rental of a Space (a private self-service gym equipped with strength and cardio machines and the related facilities) for the Customer's exclusive use for the agreed period, including the right to use the Space's equipment.

The purpose of the rental is individual recreational exercise and strength training. The rental of a Space is a leisure service provided on a specific date within the meaning of Section 1837(j) of the Civil Code.

4. Conclusion of the contract

The Customer creates a Booking through the booking system: they choose a Space, a day and the individual time blocks, fill in their contact details and submit the Booking with the “Rezervovat s povinností platby” (Book with obligation to pay) button. A Booking can be completed either without registering or with a user account; an account is not a condition of concluding the contract.

The selected blocks are temporarily held while the order is being completed. If the payment is not completed, the hold lapses and the blocks become available to other customers.

The contract is concluded at the moment the payment is received and is confirmed by an e-mail sent to the address given in the Booking. The Booking is binding and obliges the Customer to pay the price. The Operator reserves the right not to accept a Booking; in such a case it will refund any amount already paid without undue delay.

A user account is free to create and serves only to make bookings easier to manage: it pre-fills contact details, gives the Customer an overview of their Bookings and lets them be cancelled from one place. It has no effect on the price, the scope or the terms of a Booking.

When creating an account the Customer provides a name, an e-mail address, a telephone number and a password, and is obliged to keep these details accurate and up to date. Creation is completed by following a link sent to the e-mail address given. Bookings the Customer previously made without an account under the same e-mail address are linked to the account.

The Customer is obliged to protect their account credentials and not to share them with anyone else; the Customer is responsible for acts carried out through their account. If they suspect the account has been misused, they must change the password without undue delay and inform the Operator.

The Customer may close the account at any time in the “Můj účet” (My account) section, including while upcoming Bookings exist. Closing the account does not affect contracts already concluded — paid Bookings remain valid, the access code is still sent to the number given on the Booking, and the Customer continues to manage them through the link in the confirmation e-mail. After the account is closed the Operator anonymises the personal data stored in the account to the extent described in the Privacy Policy; the details on individual Bookings and on tax documents are unaffected. The Operator reserves the right to close an account if the Customer materially breaches these Terms.

5. Bookings, rental period and house rules

Bookings are made in 74-minute blocks; a Booking may be a single block or several consecutive ones. The exception is the block from 13:15 to 14:14, which lasts 59 minutes.

No more than three people may use a Space at the same time under one Booking.

Before the rental begins, the Customer receives an access code by text message and e-mail. The code is valid only for the duration of the Booking, is non-transferable and must not be shared with third parties.

The rental period is fixed. The Customer may enter the Space no earlier than at the start of the first booked block and must clear and leave it no later than at the end of the last booked block. Changing and any use of the shower count towards the rental period.

Overtime: if the Customer does not leave the Space on time, the Operator is entitled to charge, for each block of overtime started, the price of a whole additional block according to the current price list, even if the overtime lasts only a few minutes.

At the end of the rental the Customer must return the Space in the condition in which they took it over (allowing for normal wear and tear), tidied and with the equipment returned to its original place.

6. Price and payment terms

The prices of individual blocks are shown in the booking system, are in Czech crowns and are final. The Operator is not a VAT payer. The price may vary by Space, day and time of day; the price shown at the moment the Booking is submitted is decisive.

Payment is made online, cashless and in advance through the GoPay payment gateway. The Operator issues the tax document electronically and sends it to the Customer's e-mail.

If the Customer applies a valid discount code, the discount is taken into account when the price is calculated in the booking system.

7. Cancellation and withdrawal from the contract

Cancellation by the Customer more than 24 hours before the start of the first booked block: the Customer is entitled to a refund of the price paid, less a cancellation fee of CZK 20. The cancellation fee is charged once per refund, however many blocks the Customer cancels at the same time; if the amount to be refunded is lower than the cancellation fee, it is set off against the fee in full. The amount is refunded without undue delay to the payment method used.

Cancellation less than 24 hours before the start of the first booked block, or failure to show up (no-show): the entitlement to a refund of the price paid lapses.

Exclusion of the right of withdrawal: as this is a contract for a leisure service that the Operator provides on a specific date booked by the Customer, a Customer who is a Consumer does not, under Section 1837(j) of the Civil Code, have the right to withdraw from the contract within 14 days under Section 1829(1) of the Civil Code. This does not affect the cancellation terms in Articles 7.1 and 7.2.

Cancellation by the Operator: if operational, technical or safety reasons prevent the Space from being provided, the Operator is entitled to cancel the Booking. In such a case it refunds the full amount paid to the Customer or, by agreement, offers an alternative date.

8. Rights and obligations of the parties, house rules

The Operator must hand over the Space in a condition fit for the agreed purpose and ensure its regular maintenance.

Only persons over 18 may use the Space on their own. A person under 18 may use the Space only when accompanied by an adult who takes full responsibility for them.

The Customer uses the Space and its equipment at their own risk. Before starting to exercise, they must check the condition of the equipment and use it only safely and as intended; if they do not know how to operate a machine, they must not use it. The Operator is not liable for injury or damage to property resulting from use of the Space or equipment contrary to these Terms, the house rules or the intended use, or from the Customer's own carelessness. This does not affect the Operator's liability for harm that cannot be waived in advance under the law.

The Customer is liable for damage caused in the Space by them or by the people they let into the Space, and for the safety and conduct of all those people. They must report any defect or damage found to the Operator at the contact e-mail without undue delay.

The Customer acknowledges that, to protect property and for safety, the Space is monitored by a recording camera system. Details of how the recordings are processed are given in the Privacy Policy.

In the Space it is prohibited to smoke, consume alcohol or narcotic substances, handle open fire, tamper with the electrical installation or the access system, cover or disable the cameras, bring in animals, take photographs or recordings with inappropriate content, or sublet the Space in any way. The Customer must be considerate to the neighbourhood and observe night-time quiet hours under generally binding regulations.

For hygiene reasons, the Customer wears clean sports shoes when exercising and uses a towel when in contact with the machines.

If the Customer seriously breaches these Terms, endangers health or safety, or causes damage, the Operator is entitled to terminate the rental with immediate effect without a refund and to refuse the Customer future Bookings, even without giving a reason.

The Operator is not liable for being unable to provide the Space due to force majeure, in particular a power or internet outage, a failure of the access system, intervention by a public authority or a natural disaster. If the rental is substantially restricted or interrupted for these reasons, the Customer is entitled to a refund of a proportionate part of the price or to an alternative date.

The Operator is not liable for items brought into or left in the Space. Items left in the Space after the rental ends will be kept for a reasonable period; the Operator is not liable for their loss or damage unless caused by a breach of its legal obligations.

9. Rights arising from defective performance and complaints

Rights arising from defective performance are governed by the relevant provisions of the Civil Code and Act No. 634/1992 Coll., on Consumer Protection. The Customer has no rights arising from defective performance if they caused the defect themselves.

The Customer submits a complaint without undue delay by e-mail to info@room4fitness.cz. The Operator handles the complaint without undue delay, within 30 days at the latest.

If a defect substantially hinders use of the Space, the Customer is entitled to a reasonable discount or an alternative date; if the defect prevents use entirely, they are entitled to a refund of the price paid.

10. Personal data protection

The processing of Customers' personal data is governed by Regulation (EU) 2016/679 (GDPR) and is described in detail in the Privacy Policy.

11. Dispute resolution

The body competent for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, www.coi.cz.

12. Final provisions

Matters not covered by these Terms are governed by the laws of the Czech Republic, in particular the Civil Code. Any disputes are decided by Czech courts.

If any provision of the Terms is invalid or ineffective, this does not affect the validity of the other provisions.

The Operator reserves the right to amend the Terms. The new version is always available on this page and takes effect on the day it is published; Bookings already submitted are governed by the version in effect on the day they were submitted.
